LEGALLY BINDING WAIVER AND RELEASE OF LIABILITY

PLEASE READ CAREFULLY. THIS IS A LEGALLY BINDING WAIVER AND RELEASE OF LIABILITY.

By participating in any training session, clinic, camp, or event held by Soccer Savvy FC LLC, a Colorado limited liability company (the “Coach” or the “Business”), you acknowledge and agree to the following terms, whether booking for yourself, your child, or any participant under your account or supervision (collectively, “I” or “you”).

1. Acknowledgment of Risk

I acknowledge and fully understand that participation in soccer training, clinics, camps, or any related activities organized, operated, or sponsored by the Business involves inherent and significant risks. These risks include, but are not limited to: physical exertion; bodily injury (ranging from minor to severe, including paralysis or death); illness (including, but not limited to, communicable diseases such as COVID-19); property damage; equipment failure or misuse; slips, trips, and falls; adverse weather conditions; and negligent or intentional acts or omissions by other participants, spectators, or third parties (collectively, the “Risks”). I understand that these Risks may arise from foreseeable or unforeseeable causes, and may occur despite the use of safety equipment, adherence to rules, or the presence of staff or medical personnel.

2. Assumption of Risk

I, on behalf of myself and/or my minor child, voluntarily and knowingly assume all risks associated with participation in any activities, events, or services offered, sponsored, or affiliated with the Business, whether such risks are known or unknown, foreseeable or unforeseeable, and regardless of the cause. I understand and agree that this assumption of risk includes all Risks described above and any others that are incidental to or arise from participation, including those that may result from the negligence of the Business, the Coach, its officers, members, managers, employees, contractors, volunteers, or agents, to the fullest extent permitted by law.

3. Release of Liability

I hereby release, waive, discharge, and hold harmless the Business, Eduard Skevchuk, any assistant coaches, volunteers, facility partners, and any other affiliated persons or entities from any and all liability, claims, demands, or causes of action arising out of or related to any loss, injury, Risk, or damage - whether to person or property - that may be sustained while participating in or attending any of the Business’ activities or events.

This waiver applies to all participants under my account, including children for whom I am the parent or legal guardian. Furthermore, I understand that the Business is not liable for any unrelated children, friends, or guests brought by the participant or guardian who are not officially registered for the event.

4. Medical Treatment Authorization

In the event of a medical emergency, I authorize the Coach or their representatives to secure medical treatment on behalf of myself or any participant under my care. I accept full responsibility for any resulting medical expenses. I further agree to indemnify the Business and the Coach, and their affiliates for any and all actions taken in course of a medical emergency.

5. No Supervision Guarantee

I understand that the Business is not a daycare or childcare provider. While reasonable care is taken during sessions, the Coach is not responsible for supervising participants before or after scheduled event times, nor for any participant who leaves the field or facility without permission.

6. Photography and Media Release

I grant permission the Business to capture and use images, video, or recordings of participants for marketing, promotional, and educational purposes, without compensation. If I wish to opt out, I must notify the coach in writing.

7. Indemnification

To the fullest extent permitted by law, I agree to indemnify, defend, and hold harmless Business, its members, officers, employees, contractors, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to my or my child’s participation in any activity offered by the Business, including but not limited to any injury, illness, property damage, or death, whether caused by negligence or otherwise.

8. Agreement to Terms

By signing up for an event administered by or affiliated with the Business, I confirm that I have read and understand this Liability Waiver. I agree that this waiver applies to myself and to any and all children or participants booked under my account, and it will remain in effect for all future participation with the Business unless revoked in writing, with such notice provided to the Business at the following email address: info@soccersavvyfc.com.
